Siruv of the Rabbinical Court of Yeshiva Beth Joseph regarding Mrs. Manya Ort
The text is a bit unclear – it relates to Rabbi Yaakov Martin calling Mrs Ort to Din Torah on account of her collecting property that previously belonged to Rabbi Avraham Ort by court order.
It reads:SIRUV AGAINST MRS. MANYA ORTPertaining to the claims between R’ Yaakov Martin, plaintiff, and Mrs. Manya Ort, defendant. By request of the above-mentioned plaintiff, three summonses were served regarding the claims between them and not to continue in civil court without written permission from Bais Din. As of now the above mentioned defendant has not accepted on herself the authority of Bais Din and the obligation of Din Torah in a mutually accepted Bais Din and is continuing in civil court without permission of any Bails Din. Therefore she is a “msareves to come to Bais Din” and “a utilizer of civil courts” whose din is cited in Shulchan Aruch Yoreh Deah 334 and Choshen Mishpat 11 and 26 To this we have affixed our signature at the Bais Din, Thursday 16 Kislev 570.– Signature(Shulchan Aruch Choshen Mishpat 26:1 It is forbidden to litigate in secular court… and whoever litigates there is a Rosho and is as if he blasphemed and rebelled against the Torah… and anyone supporting someone who goes to secular court is to be excommunicated…)
